1. Introduction
Welcome to EverydayServiceNexus ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at everydayservicenexus.sbs (the "Service") operated by EverydayServiceNexus.
By booking a yacht or using our Service, you consent to these Terms. If you do not accept the terms outlined here, you should not use the Service.
2. Service Overview
At EverydayServiceNexus, we offer exclusive yacht charter services inclusive of, but not limited to:
- Yacht rentals for a day
- Evening yacht excursions
- Business getaways
- Exclusive celebrations
- Extended yacht voyages
Our services are contingent upon availability and weather conditions. We maintain the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you must:
- Be no younger than 18 years
- Provide truthful and comprehensive details
- Submit the necessary deposit as indicated in your reservation confirmation
- Concur with these Terms & Conditions
3.2 Confirmation
Confirmation of your booking will be provided once payment is received and we have issued a confirmation in writing. We maintain the discretion to deny service to any individual.
3.3 Availability
All of our yacht bookings are subject to the availability of the vessels and favorable weather conditions. We shall strive to meet your preferred scheduling requests as best as we can.
4. Payment Terms
4.1 Pricing
All stated prices are in £ and include any relevant taxes unless otherwise specified. Prices are subject to change at our discretion.
4.2 Payment Schedule
- Initial Deposit: 50% of the overall cost of the charter, payable at the time of reservation
- Remaining Balance: Payable 48 hours prior to the scheduled departure of the charter
- Extra fees (as applicable): Payable upon conclusion of the charter
4.3 Payment Methods
We accept a range of payment methods including major credit cards, electronic bank transfers, and certified bank drafts. All transactions are processed through secured, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours prior to departure: Full reimbursement minus transaction fees
- Between 24 and 72 hours before departure: 50% reimbursement
- Within 24 hours of departure: No reimbursement is provided
5.2 Weather Cancellations
Should the weather be deemed unsuitable for sailing by our skipper, we will propose to:
- Reschedule the charter to a later date at no extra cost
- Offer a full reimbursement if rescheduling is not possible
5.3 Mechanical Issues
In case there are mechanical issues with the assigned yacht, we will make an effort to provide a suitable replacement. If we are unable to do so, you will be provided with a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests aboard are expected to:
- Heed all instructions provided by the crew
- Utilize safety gear when required
- Declare any medical issues that may impact their safety on board
- Only inhabit areas designated for passengers
6.2 Prohibited Items
The following items are strictly forbidden on the yacht:
- Glassware
- Illegal paraphernalia
- All types of weapons
- Exceeding amounts of beverages (surpassing standard consumption levels)
- Pets (unless prior permission has been given)
6.3 Conduct
Passenger behavior should remain courteous at all times. We reserve the right to terminate the charter prematurely without reimbursement if passenger conduct is dangerous or interrupts others' experiences.
7. Liability and Insurance
7.1 Our Liability
Our liability is capped to the totality of your charter fees paid to us. We are not accountable for:
- Personal injuries incurred as a result of passenger irresponsibility
- Loss or damage to personal belongings
- Additional indirect, consequential, or punitive damages
- Delays due to weather or events outside of our control
7.2 Insurance Coverage
We have comprehensive maritime insurance that covers our fleet and operations. Clients are responsible for arranging their own travel and personal insurance coverage.
7.3 Assumption of Risk
By choosing to engage in our charter services, you recognize the inherent dangers involved in marine activities and accept personal responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
We maintain the right to adjust itineraries, routes, or schedules due to weather, safety concerns, or operational demands. We will strive to ensure comparable alternatives when changes occur.
9. Force Majeure
We will not be held responsible for hold-ups, disruptions, or alterations arising from events outside our reasonable control, such as:
- Extreme weather events
- Natural calamities
- Regulatory mandates
- Harbor shutdowns
- Mechanical malfunctions
10. Privacy and Data Protection
Your personal data is processed in compliance with our Privacy Policy. By utilizing our services, you agree to our collection and usage of your information as outlined in the Privacy Policy.
11. Intellectual Property
Our website's materials, such as text, graphics, trademarks, and imagery, are safeguarded by copyright and other intellectual property legislations. Unauthorized replication, dissemination, or creation of derivative works is prohibited without our explicit consent.
12. Governing Law
The governing laws of United Kingdom apply to these Terms. Any conflicts will be settled in the judiciary courts of Southampton, United Kingdom.
13. Changes to Terms
At EverydayServiceNexus, we reserve the authority to alter these Terms when necessary. The latest version and its effective date will be reflected on our website. Utilizing our services after changes implies acceptance of new terms.
